Gloucester County Child Custody Attorney helps client win parenting time motion

T.M. Gloucester County Child Custody Motion

In this case, the client was facing a motion from the father of the child for increased visitation in Gloucester County Superior Court (Woodbury).  She was very nervous because she wanted to protect the child from the father.  She wasn’t sure what she wanted to do but we assured her that if we fought the case hard and shut it down, she could then be in complete control of the parenting time schedule instead of having it forced upon her.  This allows her to protect her child much better since the father had a history of drug use, unstable housing and criminal activity.  While it involved a lot of work, we were able to shut down the father’s motion for increased visitation.

Motions for Sole Custody in New Jersey

In Nufrio v. Nufrio, 341 NJ Super 548 (App Div 2001), the Appellate Division upheld the trial court’s decision that a joint legal custodial relationship would not be in the best interests of the child. The Court found that the prime criteria for establishing joint legal custody centers on the ability of both parents to agree, communicate and cooperate in matters relating to the health, safety and welfare of the child notwithstanding animosity or acrimony that they may have towards each other. Of course, many cases involve hostility so simply stating that there is some animosity between both parents will not give one parent a leg up over another. Instead, the parent filing a motion for sole custody should be prepared with evidence to distinguish this case from the average case.
